1. ACCEPTANCE OF TERMS OF USE FOR THIS WEBSITE

Flexera Software controls and operates its websites from various locations and makes no representation that this Website is appropriate or available for use in all locations. Flexera Software products and services may not be available in Your location, and deliverables may vary among locations. If You are using the Website on behalf of Your employer, You represent and warrant that You are authorized to accept these Terms on Your employer's behalf, and that Your employer agrees to indemnify You and Flexera Software for violations of these Terms. In addition to the Terms and unless otherwise noted, the standard Flexera Software terms and conditions of sale in your jurisdiction govern purchases You make through the Website, unless You have in effect a separate valid written purchase or license agreement with Flexera Software for that product or service, in which case that separate agreement governs, and in cases of conflict, prevails.

2. YOUR OBLIGATIONS AND CONDUCT

2.3 You agree that You will not use the Website to: (a) transmit spam, bulk or unsolicited communications; (b) pretend to be Flexera Software or someone else, or spoof Flexera Software's or someone else's identity; (c) forge headers or otherwise manipulate identifiers (including URLs) in order to disguise the origin of any Content transmitted through the Services; (d) misrepresent your affiliation with a person or entity; (e) disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other users' ability to use the Website; (f) engage in activities that would violate any fiduciary relationship, any applicable local, state, national or international law, or any regulations having the force of law, including but not limited to attempting to compromise the security of any networked account or site, operating an illegal lottery or gambling operation, stalking, or making threats of harm; or (g) collect or store personal data about other users unless specifically authorized by such users.

3. CONFIDENTIALITY OF FLEXERA SOFTWARE INFORMATION
3.1 You may obtain direct access via the Website to certain confidential information of Flexera Software and its suppliers, including without limitation technical, contractual, product, program, pricing, marketing and other valuable information that should reasonably be understood as confidential ("Confidential Information"). You must hold Confidential Information in strict confidence. Title to Confidential Information remains with Flexera Software and its partners.
3.2 Your obligations regarding Confidential Information expire five (5) years after the date of disclosure. Upon termination of the Terms or Flexera Software's written request, You must cease use of Confidential Information and return or destroy it.
3.3 The Terms impose no obligation upon You with respect to Confidential Information that You can establish by legally sufficient evidence: (a) You possessed prior to Your receipt from Flexera Software, without an obligation to maintain its confidentiality; (b) is or becomes generally known to the public through no act or omission by You, or otherwise without violation of the Terms; (c) You obtained from a third party who had the right to disclose it, without an obligation to keep such information confidential; (d) You independently developed without the use of Confidential Information and without the participation of individuals who have had access to it, or (e) in response to a valid order by a court or other governmental body, as otherwise required by law, or as necessary to establish the rights of either party under these Terms and as disclosed after prior notice to Flexera Software adequate to afford Flexera Software the opportunity to object to the disclosure.

4. CONTENT SUBMITTED TO Flexera Software

You agree to comply with the Flexera Software Trademark and Logo Usage Requirements. You may not remove or alter any Flexera Software Trademarks, or co-brand your own products or material with Flexera Software Trademarks, without Flexera Software's prior written consent. You acknowledge Flexera Software's rights in Flexera Software Trademarks and agree that any use of Flexera Software Trademarks by You shall inure to Flexera Software's sole benefit. You agree not to incorporate any Flexera Software Trademarks into Your trademarks, service marks, company names, Internet addresses, domain names, or any other similar designations, for use on or in connection with computer or Internet-related products, services or technologies.
10.3 Flexera Software is committed to respecting others' intellectual property rights, and we ask our users to do the same. 10.4 Unless explicitly stated herein, nothing in these Terms shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication, or otherwise. 14. GENERAL TERMS
14.1 The Terms constitute the entire agreement between You and Flexera Software relating to their subject matter, and cancel and supersede any prior versions of the Terms. No modification to the Terms will be binding, unless in writing and signed by an authorized Flexera Software representative. You must not assign or otherwise transfer the Terms or any right granted hereunder. You also may be subject to additional terms and conditions that may apply when You use Flexera Software or third-party products or services.
14.2 You agree that any material breach of Sections 2, 3, 4, 6, and 10 of the Terms will result in irreparable harm to Flexera Software for which damages would be an inadequate remedy and, therefore, in addition to its rights and remedies otherwise available at law, Flexera Software will be entitled to equitable relief, including both a preliminary and permanent injunction, if such a breach occurs. You waive any requirement for the posting of a bond or other security if Flexera Software seeks such an injunction.
14.3 California law and controlling U.S. federal law govern any action related to the Terms and/or Your use of the Website. Choice of law rules of any jurisdiction and the United Nations Convention on Contracts for the International Sale of Goods will not apply to any dispute under the Terms. You and Flexera Software agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, U.S.A.
14.4 Services, Content, and product derived or obtained from this Website may be subject to the U.S. export laws and the export or import laws of other countries. You agree to comply strictly with all such laws and, in particular, shall: (a) obtain any export, reexport, or import authorizations required by U.S. or your local laws; (b) not use Services, Content, or direct product from this Website to design, develop or produce missile, chemical/biological, or nuclear weaponry; and (c) not provide Services, Content, or direct product from this Website to prohibited countries and entities identified in the U.S. export regulations.

Information Collection
Personal information means any information that may be used to identify an individual, including, but not limited to, a first and last name, email address, credit card number, a company or home, postal or other physical address, other contact information, title, birth date, gender, occupation, industry, personal or product interests, other information when needed to provide a service you requested.
When you browse our website, you do so anonymously, unless you have previously indicated that you wish Flexera Software to remember your login and password. We don't collect personal information, including your email address. We do log your IP address (the Internet address of your computer) to give us an idea of which part of our website you visit and how long you spend there. But we do not link your IP address to any personal information unless you have logged in to our website. Like many other commercial websites, the Flexera Software website may use a standard technology called a "cookie" to collect information about how you use the site. Clear Gifs (Web Beacons/Web Bugs)
We employ [or our third party advertising partner employs] a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user's computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. Security contacts and procedures
Flexera Software takes security very seriously and we aim to take immediate action to address serious security-related problems that involve our products or services.
Please report any suspected security vulnerability in a Flexera Software product or service to the Flexera Software Security Response Team, security@flexerasoftware.com.
When to contact the Flexera Software Security Response Team
You should contact the Security Response Team if:
- You think there may be a security vulnerability in a Flexera Software product or service
- You are unsure about how a known vulnerability affects a Flexera Software product or service
- You want to provide feedback about our standards of service and performance. If you feel your comment or complaint is not dealt with in a satisfactory manner, please contact the technical support manager.
When not to contact the Flexera Software Security Response Team
You should not contact the Security Response Team if:
- You require technical assistance (for example, "how do I configure my firewall?" or "how do I install patches due to security alerts?")

How we respond
Email sent to security@flexerasoftware.com is read and acknowledged with a non-automated response within three working days. For issues that are complicated and require significant attention, we will open an investigation and keep you informed of our progress every five working days at minimum. Alternatively, we will provide you with a mechanism to check the status of our progress at any time.
Any information you share with us about security issues that are not public knowledge is kept confidential within Flexera Software. It is not passed on to any third-party without your permission.
Advance notification
Flexera Software does not provide an advance notification service. Security advisories are available from within our Knowledge Base.

Flexera Software produces software products that are accessible by individuals with visual, auditory, and mobility impairments.
Flexera Software understands that software applications are used by people with visual, auditory, and mobility impairments. Guidelines intended to ensure that software can be accessed by people having such impairments have been developed by Federal and Industry representatives. Flexera Software understands the importance of producing accessible software, and of adopting these guidelines. These guidelines are designed to ensure that our products are accessible by people with visual, auditory, and mobility impairments via user interface design, and assistive technology. Assistive technology includes numerous software and hardware tools, including: screen readers (which translate what's shown on a computer screen), refreshable Braille displays, screen magnification tools, and other tools.
Flexera Software addresses the accessibility of its software through an ongoing review process.
Flexera Software's products have interdependencies with the products of various other vendors. Our goal is to develop and maintain accessible products, but we cannot control the compliance of other software and hardware companies.
